By accessing and using this website (“Site”) operated by Dorfman Karate, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use this Site. These Terms govern your access to and use of all content, functionality, and services offered on or through the Site.
2. Services Offered
The Site provides information about the two Dorfman Karate dojos in South Africa, including class schedules, contact details, and the opportunity to request a free trial class.
3. Free Trial Class
3.1 Eligibility
The free trial class is offered as a one-time opportunity and is strictly limited to individuals who are genuinely interested in enrolling as a paying student with Dorfman Karate following the trial.
3.2 Duration and Scope
The free trial is valid for one (1) regular class session at a designated Dorfman Karate dojo. It must be booked in advance and is subject to class availability.
3.3 No Obligation to Enrol
Requesting and attending a free trial class does not create any obligation for the individual to enrol, nor does it create any obligation for Dorfman Karate to accept an individual for enrolment.
3.4 Assumption of Risk and Waiver
By attending the free trial class, the participant (or their parent/legal guardian if the participant is under 18) acknowledges that karate is a physical activity and involves inherent risks of injury. The participant voluntarily assumes all such risks. Dorfman Karate, its instructors, owners, and agents shall not be liable for any injury, loss, or damage to person or property arising out of the participant’s attendance at the free trial class, for any reason whatsoever.
4. Privacy and Data Collection (POPIA Compliance)
4.1 Data Collection
Dorfman Karate collects personal information (including, but not limited to, name, email address, phone number, and age/date of birth of the prospective student) when you:
- Request a free trial class via the online form.
- Contact the dojo via the online contact form.
4.2 Consent and Use of Data
By submitting your information through the Site forms, you consent to Dorfman Karate collecting, processing, and storing your data. This data will be used for the following purposes:
- Contacting you regarding your interest in the free trial class or your general inquiry.
- Enrolment administration, should you decide to become a student.
- Marketing and communication purposes, provided you have not opted out.
4.3 POPIA
Dorfman Karate is committed to protecting your personal information in compliance with South Africa’s Protection of Personal Information Act (POPIA). We will take reasonable steps to ensure that your data is treated securely and in accordance with our Privacy Policy (which may be displayed separately).
5. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Dorfman Karate or its content suppliers and is protected by South African and international copyright laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Site without express written permission from Dorfman Karate.
6. Limitation of Liability
To the fullest extent permitted by law, Dorfman Karate shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from: (i) the use or the inability to use the service; (ii) unauthorised access to or alteration of your transmissions or data; (iii) any matter relating to the Site or the free trial class.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. You agree to submit to the exclusive jurisdiction of the South African courts.
8. Changes to Terms
Dorfman Karate reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
